Das Programm PRIMA Passwort-Kiste (auch in der Kurzform PrimaPWB oder nur PWB) ist Eigentum des Autors Jens Wahl.

Diese Lizenzvereinbarung mit Haftungsbeschrnkung stellt einen rechtlich bindenden Vertrag (Lizenzvereinbarung) zwischen Ihnen als Nutzer in Form einer natrlichen oder juristischen Person (Nutzer) und des Software-Autors Jens Wahl (Urheber) hinsichtlich des oben aufgefhrten Softwareproduktes PRIMA Passwort-Kiste dar. Dies schliet alle beim Download zur Verfgung gestellten Dateien ein.

1. Zustimmung zu den Lizenzbedingungen

Die Nutzung der Software ist nur gestattet, wenn Sie allen Lizenzbestimmungen dieser Lizenzvereinbarung zustimmen. Ihre Zustimmung gilt als erklrt, wenn Sie die Software installieren bzw. nutzen. Ohne Ihre Zustimmung kommt kein Vertrag zwischen Ihnen als Nutzer und dem Urheber zustande.

2. Lizenztyp und Weiterverbreitung der Software

Das Programm PRIMA Passwort-Kiste ist Freeware und darf frei verwendet, kopiert und weitergegeben werden, wenn die folgenden Bedingungen erfllt werden:
Sie erhalten eine Lizenz oder mehrere Lizenzen zur Programmnutzung kostenfrei. Sie drfen das Programm uneingeschrnkt sowohl fr private wie auch berufliche Zwecke ohne eine Gegenleistung Ihrerseits benutzen. AUSNAHME: Der Einsatz der Software in Anwendungen oder Systemen, in denen Fehlfunktionen dieser Software nach menschlichem Ermessen krperliche Schden oder Verletzungen mit Todesfolge nach sich ziehen knnen, ist ausnahmslos untersagt! Die Benutzung der Software in einer solchen Umgebung ist nicht durch die Rechte dieser Lizenzvereinbarung gedeckt. Jede Haftung seitens des Urhebers fr Schden oder Verluste auf Grund einer derartigen unerlaubten Benutzung ist ausgeschlossen. Bei Kenntniswerden eines solchen Verstoes gegen diese Lizenzvereinbarung kann Ihnen der Urheber die Nutzungslizenz auf Dauer entziehen.
Sie drfen das Programm weder als Einzelprogramm noch mit anderer Software gebndelt zum Kauf anbieten.
Sie drfen das Programm auf einer nicht kostenpflichtigen Internetseite zum kostenlosen Download anbieten. Dazu muss die komplette Installationsdatei weitergegeben werden. nderungen am Programm, Namen, Autor usw. sind untersagt und stellen Urheberrechtsverletzungen dar.
Fr alle anderen Verffentlichungsformen ist eine schriftliche Erlaubnis (Brief mit eigenhndiger Unterschrift) des Autors notwendig; diese Erlaubnis kann kostenpflichtig sein. Sie haben KEIN Recht auf Erteilung einer solchen Erlaubnis.
Das Programm bleibt auch bei Weitergabe an Dritte immer Eigentum des Autors.
Das Programm darf nicht verndert oder dekompiliert werden; insbesondere der Programmname und der Name des Autors drfen nicht verndert werden.
Der Autor bleibt immer Inhaber aller Rechte am Programm.

3. Sicherheitskopien

Jeder Lizenznehmer hat das Recht, von der Software eine oder mehrere Kopie(n) zum Zweck der Datensicherung anzufertigen.

Es wird dringend empfohlen, sowohl von dem genutzten Programm wie auch der zugehrenden Datenbank eine regelmige Datensicherung anzufertigen.

4. Copyright, Garantie und Haftungsbeschrnkung

Fr diese Software gilt das Copyright by Jens Wahl, Rosenheim. Alle Rechte vorbehalten.

Das Programm wird geliefert wie es ist OHNE Garantie jeglicher Art.
Der Anwender akzeptiert, dass die Nutzung des Programmes und dessen Leistungen und Dokumentationen ausschlielich auf eigene Gefahr/eigenes Risiko erfolgen.

Der Urheber garantiert NICHT:
Dass das Programm frei von Fehlern ist.
Dass das Programm ohne Unterbrechung arbeitet und in allen mglichen Umgebungen arbeitet.
Dass das Programm Ihren Ansprchen entspricht.
Dass Softwarefehler behoben werden, dass das Programm an spezielle Bedingungen angepasst wird oder dass neue Versionen/Updates des Programmes zur Verfgung gestellt werden.

Es wird keine Garantie fr die Funktionsweise gegeben.
Fr Schden, die aus der Nutzung des Programmes entstehen (z. B. Datenverlust, Betriebsunterbrechungen, entgangener Gewinn und alle anderen finanziellen Verluste) bernimmt der Autor mit Ausnahme des Nachweises von vorstzlichem Handeln bzw. grob fahrlssigem Handeln KEINE HAFTUNG, auch wenn die Schden htten vorhersehbar sein mssen.

Die Software wird virengeprft ausgeliefert. Dennoch liegt es in der Verantwortung des Nutzers, regelmige Tests auf Virenfreiheit durchzufhren, z. B. sofort nach dem Erhalt der Installationsdatei (Download). Der Urheber haftet nicht fr solche vermeidbaren Schden.

Der Einsatz der Software in Anwendungen oder Systemen, in denen Fehlfunktionen dieser Software nach menschlichem Ermessen krperliche Schden oder Verletzungen mit Todesfolge nach sich ziehen knnen, ist ausnahmslos untersagt! Die Benutzung der Software in einer solchen Umgebung ist nicht durch die Rechte dieser Lizenzvereinbarung abgedeckt. Jede Haftung seitens des Urhebers fr Schden oder Verluste auf Grund einer derartiger unerlaubten Benutzung wird ausgeschlossen.

Durch das Herunterladen und Installieren stimmt der Nutzer diesen Lizenzbedingungen zu. Diese werden daher whrend der Installation in gleichem Wortlaut vorab bekannt gegeben. Zustzlich kann diese Datei mit den Lizenzbedingungen getrennt von der Installationsroutine herunter geladen und VOR der Installation gelesen werden.

5. Schlussbestimmungen

nderungen dieser Lizenzvereinbarung bedrfen der Schriftform und mssen vom Nutzer und dem Urheber unterzeichnet sein.
Sollten Teile dieser Lizenzvereinbarung unwirksam oder undurchsetzbar sein bzw. werden, wird die Wirksamkeit und Durchsetzbarkeit der brigen Bestimmungen dieser Lizenzvereinbarung hiervon nicht berhrt. Die Parteien verpflichten sich in diesem Fall, anstelle der unwirksamen Bestimmung eine wirksame Bestimmung zu vereinbaren, die dem wirtschaftlichen Zweck dieser Lizenzvereinbarung so nahe wie mglich kommt.

Es gilt das Recht der Bundesrepublik Deutschland. Gerichtsstand ist Rosenheim / Obb.

The program PRIMA Password Case (or short also PrimaPWB or PWB) is the property of the author Jens Wahl.

This licensing agreement with liability limitations is a legally binding contract (Licence agreement) between you as user as a natural or legal person (User) and the software author Jens Wahl (Author) in question to the above named software product PRIMA Password Case. This includes all additional files to this software.

1. Terms of a licence

The usage of this software is only allowed if you agreed with all terms of this licence agreement. Your compliance is manifested if you have installed the software or you use it.
Without your compliance there is no contract between you as user and the author.

2. Licence type and retransmission of the software

The program PRIMA Password Case is freeware and may be freely used, copied and passed on, if the following conditions are met:
The full program for both private and business purposes may use for free. EXCEPTION: The usage of this software in applications or systems, in which malfunctions of this software as far as it is humanly possible can create bodily injury or bodily harm with fatal consequences is not allowed! The usage of this software in such environments is out of this licence agreement. Every liability of the author is excluded for damages or deficits because of such a not allowed usage. If the author get knowledge of offences against this licence agreement he can deprive you the licence to use this software for all time.
You can use the program but not offer it for sale as a single program or bundled with other software.
You may not offer the program on a fee-based website for free download.
For all other types of publication, a written authorization (letter personally signed) is required by the author, this permit may be charged. You have NO right to grant such permission.
The program will also transfer to third parties ever owned by the author.
The program must not be altered or decompiled, in particular, the program name and the name of the author may not be changed.
The author remains the owner of all rights to the program.

3. Safety Copies

Every licence holder has the right to create one or more copies for saving reasons.

It is strongly recommended to create data backups of the software.

4. Copyright, warranty and liability limitations

This software is Copyright by Jens Wahl, Rosenheim. All rights reserved.
The program is supplied as is without warranty of any kind
The user accepts that the use made of the program and its services and documentation at their own risk / own risk.

THE AUTHOR DOES NOT WARRANT:
That the program is free of errors.
That the program is working without interruption.
That the program meets your needs.
That software errors will be corrected, that the program will be adapted to specific conditions or that new versions / updates of the program are provided.

There is no warranty for the functionality.
For damages resulting from the use of the program (e. g., data loss, business interruption, loss of earnings and other financial losses), the author accepts NO RESPONSIBILITY, even if the damages were foreseeable.

The software is virus detected. But it lies in the liability of the user to run virus detection on its computer(s) periodical, especially after the download. The author is not liable for such damages.

if the user downloads or installs this software, the user agrees with all terms of this licence agreement. Hence, these are announced during the installation in the same text to begin with. In addition, this file can be downloaded with the licence terms apart from the installation routine and can be read before the installation.

5. Final regulations

Changes of this licence arrangement need the written form and must be signed by the user and the originator.
Should parts of this licence arrangement be ineffective or unenforceble or become, from this the effectiveness and enforceability of the remaining regulations of this licence arrangement is not touched. In this case the parties undertake to agree on an effective regulation instead of the ineffective regulation which comes to the economic purpose of this licence arrangement so near as possible.

It is worth the right of the Federal Republic of Germany. Legal venue is Rosenheim / Upper Bavaria.
